Schuyler Man Heads to Trial for Sexual Assault, Incest

SCHUYLER - A Schuyler man is heading to trial on incest and 1st degree sexual assault of a child charges, after pleading not guilty to both. Court records say the man, who is not named to protect the victim, is currently heading to a jury trial on January 11th. The man is also set for a status hearing on December 20th. The charges stem from an incident from June of this year. READ MORE ABOUT THE ARREST AND CHARGES BELOW: SCHUYLER, Neb. – A Schuyler man will make his first appearance in court after his daughter told police he had sexually assaulted her for four to five years. A 47-year-old man, who’s name is not listed to protect the victim, is charged with two felonies, first-degree sexual assault of a child and incest. According to the affidavit, in interviews with police and child advocacy groups, the man’s 12-year-old daughter said that he had sexually assaulted her around 20 times since she was seven or eight years old. The documents say that on some of these occasions, the man came into her bedroom while her mother was gone and while the alleged victim was asleep, and would sexually assault her. The affidavit says she told investigators that she does not believe they ever had intercourse, but she said “he would put his thing on my thing.” The affidavit says that she told authorities that he would ask his daughter if he could take her virginity several times. The affidavit says he would tell her that “it isn’t bad, because the bible says love isn’t bad.” She also told police that he would promise to buy her things and at one point, she said he bought her a puppy after she performed oral sex on him. The affidavit says the girl confided in her sister about the incidents and her sister, who is now an adult, said that he also sexually assaulted her as a child. The court documents says that the girl also eventually told her mother about the abuse and when her mother confronted the man, he said “it’s their word against his.” The Schuyler police say they arrested the man without incident, and first transported him to the hospital for preexisting medial conditions and police believed the man to be highly intoxicated at the time. Police say when they explained the charges to the man, he smiled and asked “do you have proof?” He will appear in Colfax County court on Tuesday and is currently being held on $250,000 bond. He will also be arraigned on a separate DUI charge on Tuesday.
