OSCEOLA, Neb. - A Clarks man pled not guilty this week to five felony charges, in an incident where authorities say he shot at Polk County sheriff deputies.
38-year-old Douglas Burke is charged with five felonies from an incident in August.
According to court records, sheriff deputies attempted to stop a vehicle in rural Polk County that they believed was stolen. The records say when they began pursuing the vehicle, gun shots fired back at the deputies.
With the help of area law enforcement, Burke, the driver, and his passenger, 25-year-old Derek Hobbs, eventually surrendered, according to documents.
Nobody was injured during the incident on August 5th.
The Polk County Sheriffs Office says the vehicle Burke and Hobbs were in was stolen.
Burke is charged with use of a firearm to commit a felony, possession of a firearm by a prohibited person-subsequent offense, attempted 1st degree assault of an officer, theft by receiving stolen property and operating a motor vehicle to avoid arrest.
Burke has twice been convicted of possessing a deadly weapon, once in 1999 and again in 2015.
If convicted on all charges, Burke faces a life sentence, plus an additional 122 years in prison. If he just receives the minimum sentence, Burke would still be required to spend 31 years in prison.
