Two men enter plea in Custer County District Court

BROKEN BOW- Two Custer County men had sentencing dates set in Custer County District Court on Thursday.

Lex McDaniel, age 56 of Sargent, entered a plea of guilty and was found guilty to an amended charge of resisting arrest (1st offense), a class I misdemeanor. A class I misdemeanor has no minimum charge, and a maximum charge of no more than one year imprisonment, a one thousand dollar fine, or both. As a result of the guilty plea, charges against him of use of a firearm to commit a felony (class 1C felony), terroristic threats (IIIA felony), and committing intentional child abuse with no injury (IIIA felony) were dismissed.

McDaniel’s sentencing was set for April 18, 2024.

Blake Chapin, age 34 of Broken Bow, also entered a plea resulting in amended charges. Chapin pled no contest and was found guilty of committing negligent child abuse without injury, a class I misdemeanor. A class I misdemeanor has no minimum charge, and a maximum charge of no more than one year imprisonment, a one thousand dollar fine, or both. The no contest plea resulted in two charges of third degree sexual assault of a child (class IIIA felonies) being dismissed.

Chapin’s sentencing was set for May 2, 2024.
