Sentencing Handed Down To Man Who Assaulted Two In Blaine County

BLAINE COUNTY— According to Blaine County District Court records, a man will be imprisoned in the Nebraska State Penitentiary in Lincoln for the next 16-20 years after being found guilty of assaulting a woman near Dunning. Jesus Magallanes Jr., 43 of Lincoln, was found guilty of 2nd Degree Assault with a deadly instrument, on September 11, against Elizabeth Komack.

According to a source close to the victims and court records, on April 16, 2017 Magallanes broke into a home where Komack was residing along with Miller Heller. Magallanes struck both Heller and Komack which resulted in Komack receiving stitches and Heller being admitted to the hospital. Magallanes was arrested and booked into Custer County Jail after his I.D. was found near the scene of the assault.

According to court records, the assault against Heller was dropped due to insufficient evidence, but Magallanes pled no contest in District Court to the assault against Komack. 2nd degree assault is a class IIA felony which has a maximum sentence of 20 years with no minimum sentence. Magallanes will be eligible for parole after serving eight years in the state penitentiary pending good behavior. Magallanes was also credited for 316 days already served.
