Recap of Custer County District Court Criminal Cases for May 22nd

Only a few criminal cases were on the docket for Custer County District Court on Thursday, May 22nd.

Sentencing for Kindra A. Potter, age 33 of Berwyn, was scheduled. However, the defendant failed to appear. Her attorney, Chris Wickham, asked for another continuance in the case. However, County Attorney Steven Bowers argued against the request due to the defendant’s past history. Judge Karin Noakes denied the request for continuance and issued a bench warrant for Ms. Potter, setting a bail amount of $75,000 with 10% privilege with the bench warrant. In January of this year, Potter entered into a plea agreement in her case. She pleaded guilty to 1st degree forgery, a Class III felony in one case and seven counts in a second case were dismissed.

Sabino Laborde, age 35 of Sioux Fall, South Dakota, was sentenced on Thursday. In August of 2023, he was charged with possession of a controlled substance with intent to distribute, a Class II felony. Judge Noakes sentenced Laborde to 90 days in the Custer County Jail as well as five years of traditional supervised probation. The defendant was given credit for 11 days he had already served in jail.
