District Court Recap: January 26

BROKEN BOW – The Custer County District Court heard 7 cases on Thursday morning after having been snowed out on its previously-scheduled January 19 date.

Shelby R Butzke, 29 of Kearney, entered a not guilty plea to a charge of alleged possession of a controlled substance, a Class IV felony. Butzke is anticipated to enter problem-solving court, with a progression conference scheduled for February, and a jury trial scheduled for June.

Tanner B. Bowers, 32 of Broken Bow, was present for two cases, and reached a plea agreement in both. In his first case, Bowers would plead guilty or no contest to one count of theft by unlawful taking $1500 to $4999, a Class IV felony, and the payment of $1978.23 to Custer Public Power District in exchange for a dismissal of a second theft charge. Bowers’ sentence includes 1-3 years in jail with credit for 260 days served.

Bowers’ second charge was burglary, a Class IIA felony. In exchange for a guilty or no contest plea, Bowers will receive a minimum 1 year and maximum 3 year jail sentence, with credit for 260 days served. Bowers will serve his sentences concurrently.

Dominique Ducote, 50 of Grand Island, did not appear to face a charge of theft by unlawful taking of more than $5000, a Class IIA felony. A warrant had been issued on December 1, 2022 for Ducote, who is currently being held in the Hall County jail on different charges. A jury trial is scheduled for June.

Justin S. Arrowsmith, 38 of Broken Bow, reached an agreement with the court that amended original felony charges in his case to 1 count of disturbing the peace, a Class III misdemeanor. Arrowsmith would also receive a 2-day jail sentence, with credit for his 2 days served.

Glen W. Jenkins, 55 of Ansley, had his case continued into June. Jenkins is facing charges of first degree sexual assault, a Class II felony, burglary, a Class IIA felony, abuse of a vulnerable adult, a Class IIIA felony, and a second offense DUI, a Class W misdemeanor.
