Bret M. Samuelson, age 42 of Arnold, appeared for arraignment in Custer County District Court on Thursday, February 5th. However, defense attorney Matt Furrow had previously filed a plea in abatement that would have to be ruled on before proceeding to arraignment. A plea in abatement is essentially an appeal of the county court’s determination at the preliminary hearing that there was probable cause that a crime was committed and that the defendant likely committed the crime. Judge Karin Noakes scheduled the hearing on the plea of abatement for April 2nd. Samuelson is charged with one count of child abuse, intentionally causing injury, a Class II felony.
