Custer County District Court News

The Custer County District Court criminal docket consisted of only one case on Thursday, July 25th. Connor  W. Capps, age 24 of California, appeared remotely before Judge Karin Noakes. Capps’ attorney, Chris Wickham, was present in court and represented Capps on his motion for early release and withdraw of plea. On March 24, 2022, Capps pleaded no contest to possession of a controlled substance-cocaine and in July of 2022, Capps was sentenced to three years probation.  During Thursday’s hearing, the State indicated Capps had successfully met probation requirements to-date, including payment of fees. Judge Noakes then ruled that the defendant was allowed to withdraw his previously entered plea and dismissed the case with prejudice.

An arraignment for Charles E. Robinson, age 53 of Colorado, had been on Thursday’s docket. However, on Wednesday, July 24th, Robinson entered a written not guilty plea for possession of a controlled substance with intent to distribute (fentanyl). A pretrial hearing for Robinson is set for September 19, 2024 at 9:30 a.m.
