Custer County District Court Hears New Felony Charges

Two criminal cases came before Custer County District Judge Karin Noakes on Thursday, May 23rd.

In the first case, 13 additional charges were filed against Timothy A. Rosentrater, age 62 of Callaway. The charges involve 1st degree sexual assault, Class II felonies; sexual assault of a child, Class IIIA felonies, 2nd degree sexual assault, a Class III felony, and 3rd degree sexual assault, a Class I misdemeanor.

The new charges stem from alleged incidences that occurred in 2001, 2003, 2004, 2006, and 2024. A preliminary hearing for the charges was set for June 27th at 1:00 p.m. Rosentrater is currently in the Custer County jail after being arraigned in March 2024  on a charge of 1st degree sexual assault, a Class II felony. A pretrial hearing in that case is scheduled for October of this year.

John T. Anderson V, age 31 of Arapahoe, Nebraska, appeared in court for an arraignment. Anderson is charged with motor vehicle homicide, a Class IIIA felony; and willful reckless driving, a Class II misdemeanor.

Anderson entered not guilty pleas to both charges.  A jury trial has been set for October 15, 2024 with a pretrial conference on September 19th.

Anderson’s charges stem from an August 18, 2023, three-vehicle crash on Highway 2 near Road 812, southeast of Anselmo. Anderson was driving a semi eastbound when he crossed the white line resulting in the semi and attached trailer to tip onto its passenger side and slide into the westbound lane. Patrick Stauffer, of Willis, Texas who was driving a pickup that hit the trailer died as a result of the accident.
