Custer County District Court hears 6 cases Thursday morning

BROKEN BOW – The Custer County District Court heard 6 criminal cases Thursday morning.

Darrin L. Ostrander, 28 of Broken Bow, appeared for an arraignment in his case. Ostrander is facing one count of alleged first-degree sexual assault, a Class II felony. He entered a not-guilty plea, and his case will move to a jury trial set for October.

James N. Thompson, 35 of Gothenburg, did not appear before the court; his case was set for a pretrial hearing. Thompson faces 4 allegations to which he had previously pled not guilty: burglary and theft by unlawful taking of more than $5000, both Class IIA felonies, possession of a firearm by a prohibited person, a Class ID felony, and criminal mischief, a Class II misdemeanor.

Hunter L. Eller, 26 of Oconto, appeared for a pretrial conference. Eller reached a plea agreement with the court. In exchange for a guilty or no contest plea, the two allegations in his case would be reduced to misdemeanors. Eller had initially been charged with two counts of first-degree sexual assault, Class II felonies. His case was moved on to sentencing, set for July.

Daniel D. Marshall, 49 of Dunning, appeared for his pretrial conference, wherein a tentative agreement had been reached with the court, which could include a possible dismissal. His case was continued until October.

Jonathan E. Fuller, 36 of North Sioux City, South Dakota, also appeared for a pretrial conference; in his agreement with the court, he would plead guilty to his single domestic assault charge to have it reduced to threatening another in a menacing manner, a Class I misdemeanor.

Glen W. Jenkins, 56 of Ansley, appeared for a pretrial conference and had a motion for deposition sustained; his case will be continued into October. Jenkins is currently facing 4 allegations: first-degree sexual assault, a Class II felony, burglary, a Class IIA felony, abuse of a vulnerable adult, a Class IIIA felony, and a DUI second offense, a Class W misdemeanor.
