BROKEN BOW – The Custer County Board of Supervisors met in a regular session on November 28 at 9:00 a.m. All members were present.
The board approved minutes from the last meeting, and mail and committee reports were reviewed.
The Board of Equalization opened up, and the motion to approve the contract for property appraisal was approved by all board members but Anne Gibbons who voted no.
The board approved the application to cross right away for Hunt and Hunt Land LLC for an inch-and-a-half pipe for cattle 1/2 miles northeast of Anselmo on County Road 430, and Jill Horke for an inch-and-a-half to two-inch underground pipe for cattle on the intersection of Road 448 and West Union Road.
The Board approved a change order for a deduction in the amount of -$32557.98, to Execute the Certificate of Substantial Completion and the application for payment for the 2022 Custer County Paving Project in the amount of $20,000.
Rick Adams, the Zoning Agent for Horvath Towers spoke to the board about the proposal of a 300 ft tower to be built west of Cumro Road #23-10-1. He stated there was a slight reduction in the setback from 300 ft. to 250 ft.
The board approved the Conditional Use Permit for #23-10-1 to reduce the tower setback from 300 ft to 250 ft.
Resolution #68Z-23-Zoning Moratorium-Poultry regulations were approved by the board.
At the last meeting, the board requested that Miller and Associates and Paulsens be present in this meeting. The board came to a decision to amend the payment to $25,758, and the board will go into mediation with Miller and Associates for 1/3 the amount of the change order, and if there is any portion that is in excess of the $25,758 that the board will forward that onto Paulsens.
