Appearing in Custer County District Court on Thursday, November 13th, was Sam Payton, age 47 of Callaway. Payton appeared for a motion to revoke his post-release supervision plan as he allegedly violated several probation conditions. In March of 2024, Payton was found guilty of making terroristic threats, a Class IIIA felony, sentenced to 18 months incarceration in the Custer County Jail, and ordered to serve 12 months of supervised probation after his release. On Thursday, Payton waived his right to an attorney and admitted to all violations. Judge Karin Noakes found he violated terms of his probation plan and ordered a new presentence investigation. Sentencing was scheduled for January 8, 2026 and Payton was remanded to custody of the Custer County Sheriff.
Gabriel C. Beck, age 26 of Broken Bow, appeared in District Court for a hearing on failure to report to jail. A warrant for Beck’s arrest had been issued in the case. Judge Noakes reinstated the defendant’s sanction of 10 days in jail with credit for 7 days served. After completion of the sanction, Beck was ordered to report to the probation office while he awaits restarting the drug court program.
In court for a status conference hearing was Genevieve M. Soland, age 43 of Fairmont, Minnesota. The court was told a plea agreement had been reached in the case. In exchange for dismissal of three counts (possession of a financial transaction device that wasn’t hers, a Class III misdemeanor; possession of marijuana of one ounce or less, an infraction; and possession of drug paraphernalia, an infraction), Soland pleaded guilty to one count of criminal attempt, a Class I misdemeanor. Judge Noakes found her guilty of that charge and ordered her to pay a $1,000 fine and costs.
