Recap of Custer County Court on October 6th

Custer County Court was in session on Monday, October 6th with Judge Tami Schendt presiding.

Christopher E. Muggy, age 52 of Broken Bow, appeared for a preliminary hearing in his case.  On September 23rd, Muggy was charged with 3rd degree domestic assault, a Class IIIA felony. He waived his right to a preliminary hearing and Judge Schendt bound the case over to Custer County District Court where he will appear on October 16th. Muggy’s bond remained at $5,000 with a 10% privilege and he was returned to the custody of the Custer County Sheriff.

Also appearing in court was Preston J. Foster, age 38 of Broken Bow. Under a plea agreement reached with the State, Foster entered a plea of no contest to one count of DUI-3rd offense, a Class W misdemeanor. In accordance with the plea agreement, three other counts were dismissed. In February of this year, the defendant was charged with four counts, including a felony charge of DUI-3rd offense. Judge Schendt found Foster guilty of the amended charge and sentencing was set for November 3rd.
