Only a couple of criminal cases were on the Thursday, September 25th,Custer County District Court docket.
Appearing for an entry of plea hearing was Cody L. Patterson, age 33 of Arnold. It was announced that a plea agreement had been reached in the case resulting in the defendant pleading guilty to DUI-4th offense, a Class IIIA felony. Per the agreement, a second count was dismissed. Judge Karin Noakes found Patterson guilty but deferred sentencing until the defendant completes the North Central Drug Court program. Bond was modified in the case to a $1,000 personal recognizance bond.
Jesse L. Menzie, age 49 of Sargent, appeared remotely for a competency review. His counsel, Andrew Hanquist was present in court. An evaluation conducted by staff at the Lincoln Regional Center was admitted as an exhibit in the case. The evaluation stated the defendant was not yet competent to stand trial and stated Menzie needed further treatment and therapy. Another competency review will be held after 60 days. In August of 2024, Menzie was charged with one count of 1st degree assault, a Class II felony; one count of child abuse, a Class IIIA felony, one count of stalking, a Class II felony, and one count of criminal mischief, a Class III misdemeanor.
