Probation Given to Duncan Man Convicted of Possessing Child Porn

COLUMBUS, Neb. - A Duncan man convicted of possessing of child porn was spared prison time by a Platte County judge on Friday. 38-year-old Whitney Micek was sentenced to three years probation by Judge Robert Steinke in Platte County District court, after being found guilty earlier in the summer of two felony counts of possessing child porn. He will also have to register as a sex offender. Micek was arrested in December of 2016 after, according to court records, investigators found 375 images of child porn on Micek's laptop and phone while serving a warrant at his Duncan home. He was originally charged with 13 counts of possessing child porn, before reaching a plea deal. The prosecution, the probation office and Micek's attorney Michael Moyer all recommended to Judge Steinke that Micek be given probation. Moyer cited Micek's lack of a prior criminal record, his sexual abuse as a boy and his strong family support as reasons for a probation sentence. Judge Steinke ultimately agreed and said that he believes Micek is remorseful and cited a survey that listed Micek as "low risk" before handing down his sentence. Micek also told the court in a short statement that "I'll do anything and everything to make this right." As terms of his probation, Micek will have to complete his private porn addiction counseling that he has already begun, a one-day community justice program, a cognitive behavior program and attend Sex Addicts Anonymous meetings at least once a week. He is also barred from using drugs, alcohol or the internet during his probation.
