No Jury Trial For Norfolk Child Death Case

MADISON, NE — A Norfolk woman accused of killing her four-year old daughter will not be facing a jury after all. Twenty-two year old Carla Montoya waived her right to a jury trial in Madison County Court Monday. At 3:50 Monday afternoon, more than two hours after media was told she would be called up, waived her rights to a jury trial in Madison County District Court. Montoya faces 20 years to life in prison for child abuse that resulted in her daughter, Caylee Hoehne's death last year. Investigators said in court documents that Montoya admitted to them that she tossed Caylee onto a bed, causing the injuries that eventually killed her. The trial, which has already been delayed almost a year and a half, is set for November 1 at 9:00 a.m. Paternal grandfather of Caylee Hoehne told News Channel Nebraska that the “family is sick of delays” and concerned more could come. Madison County Attorney Joe Smith says he anticipates the bench trial to take one to two day.
