Federal Appeals Court Denies Lawsuit Against Officer

OMAHA - The Eighth Circuit Court of Appeals is rejecting a lawsuit against a former Norfolk Police Officer. In an opinion submitted on July 14th, the federal appeals court affirmed a lower court ruling in the lawsuit against officer Daniel Hallock. Hallock was sued by Kirk Vester, who argued that Hallock used unnecessary force during Vester's arrest outside the 101 Bar and Grill in Hadar back in 2013. Hallock had been dispatched to the scene after reports that Vester was threatening patrons there with a knife. Vester objected to Hallock's use of an "armbar" to take him to the ground. But the U.S. District Court ruled in 2015 that Hallock's takedown was not an example of unnecessary force. That opinion was affirmed by the 8th Circuit Court. Vester ended up serving just over a year in prison for terroristic threats and other charges related to his arrest. Hallock has since gone on to become a deputy with the Antelope County Sheriff's office.
