BROKEN BOW--A Broken Bow man is currently facing charges of first degree sexual assault (class II felony), first degree false imprisonment (class IIIA felony), and third degree domestic assault (class I misdemeanor). Marco Antonio Garcia, 29, pled not guilty to all three counts on Thursday morning.
Attorney Mike Borders asked for a PR bond and said the alleged victim has left town but an investigation is underway as to whether or not she told the truth of what happened. County Attorney Steve Bowers said a woman was found by police in a locked room with Garcia and that bruises were later examined after a hospital visit. Bowers also gave examples of Garcia’s criminal history including counts of theft, burglary, and evading arrest.
Bowers asked Judge Karin Noakes to leave the bond at $100,000, 10% because he feels Garcia is a danger to the community and a flight risk. According to Bowers, Garcia had only been in Custer County for seven days (from Texas) before his arrest on October 27. A trial was set for February.
Zachary C. Hillis appeared in District Court for arraignment for alleged second degree forgery (class IV felony). Hillis pled guilty on Thursday and was ordered to pay restitution in the amount of $3,500 to local Bartak business. He was sentenced to one to two years incarceration, to be served concurrent with a sentence in Montana.
Sentencing for Jesse L. Hare was continued to December 7. Devin Jaworski will appear for sentencing on December 21. Probation was extended for Christopher Gallet on two counts. Terms of probation are to be served concurrently.
