CUSTER COUNTY—Thirty-eight year old Brian R. Middour pled not guilty to the three counts he currently faces in District Court. Middour is charged with unlawful intrusion (class IV felony), sexually explicit conduct (class IIA felony), and visual depiction of sexually explicit conduct (class ID felony).
These charges follow an incident that allegedly took place on December 5, 2017. Counts two and three--alleging possession of and creation of sexually explicit conduct--are said to have involved a child as one of its participants, according to court documents.
Attorney Mike Borders is currently representing Middour. Judge Karin L. Noakes scheduled the case for jury trial on February 12.
Also during Thursday morning’s District Court session, cases for Dezarey R. Shimko and Robert E. Edwards Sr. were continued. Amy Lytle of Broken Bow denied allegations of probation violations and will appear on February 8 for a pretrial conference.
Additional witnesses were endorsed for the case of Mitchell E. Burnett and a continuance was requested for Devin R. Jaworski. A jury trial for Marshall Marshall, 35, was rescheduled to June 11.
