Meeting Procedure
The Public may address specific agenda items at the pleasure of the Mayor. Please come to the podium, state your name and address, and limit your remarks to five minutes or less. Out of respect to City employees, we request that any complaints or criticisms of employees not be aired in a public meeting. Concerns about employees should be brought to the attention of the City Administrator or Mayor. An individual in violation will be declared out of order.

B. Open Meetings Act: This is an open meeting of the Broken Bow City Council. The City of Broken Bow abides by the Open Meetings Act in conducting business. A copy of the Open Meetings Act is displayed in this room as required by law.

E. Submittal of Requests for Future Items: Individuals who have appropriate items for City Council consideration should complete the Request for Future Agenda Items. If the issue can be handled administratively without Council action, notification will be provided. If the item is scheduled for a meeting or study session, notification of the date will be given.

F. Consent Agenda: Consideration of approving the consent agenda items for November 12, 2019, which will include the following:
a. Approval of Minutes of October 22, 2019 Meeting
b. Approval of Minutes of October 31, 2019 Special Meeting
c. Approval of Bills as Posted
d. Approval of Broken Bow Volunteer Fire Department

G. Unfinished Business:
a. Public Hearing on Ordinance 1214, Electric Rates – Consideration of opening a public hearing on Ordinance 1214, Electric Rates.
b. Final Reading of Ordinance 1214, Electric Rates
c. Ordinance 1214, Electric Rates – Consideration of approving Ordinance 1214, Electric Rates.

H. New Business:
a. Public Hearing on Ordinance 1216, Amending Section 93.06 Abandonment, Neglect & Mistreatment – Consideration of opening a public hearing on Ordinance 1216, Amending Section 93.06 Abandonment, Neglect & Mistreatment.
b. Waive Three Readings of Ordinance 1216, Amending Section 93.06 Abandonment, Neglect & Mistreatment – Consideration of waiving the three readings of Ordinance 1216.

g. Resolution 2019-26, Employee Appreciation Banquet – Consideration of approving the expenditures for the Employee Appreciation Banquet.
h. Resolution 2019-27, YMCA Support – Consideration of approving the support of the City of Broken Bow toward the endeavor of a Custer County YMCA.
i. Resolution 2019-28, Set Recall Election Date – Consideration of setting the Recall Election date for Mayor Jonathon Berghorst.

j. The following grievance hearing is being held per Section 7 of the City of Broken Bow Employee Handbook. The grievant has requested this hearing be held in open session. In fairness to all parties involved, the City of Broken Bow is holding a structured hearing that is not open to any public comment. Because the Mayor of Broken Bow is directly involved with this grievance and no administrator is in place, the president of the City Council will preside over such grievance hearing during the entire time of such hearing. The filed grievance will be read by the City Clerk in its entirety and displayed on available projection within the facility. Podium placement and audio usage will be determined by the presiding official.

k. Comments by Council President Rod Sonnichsen Regarding Grievance Hearing

l. Grievance Hearing for Electrical Superintendent Jeremy Tarr – Hearing on the Grievance for Electrical Superintendent Jeremy Tarr to remove the Written Reprimand from his personnel file. This hearing is not open to public comment. Both parties will be sworn in under oath and allowed to give testimony. The time allowed for each party to give testimony is 20 minutes. Electrical Superintendent Jeremy Tarr will be first to present, followed by Mayor Jonathon Berghorst. The Board of Public Works may be heard for a total of 20 minutes. Each party will be allowed final statements of 3 minutes. Questions will not be allowed during or within the testimonies.

m. Removal of Written Reprimand from Jeremy Tarr’s Personnel File –
Consideration of removing the written reprimand from Jeremy Tarr’s personnel file.

I. Comments by Mayor and Council Members Concerning City Departments.

J. Closed Session – Consideration of entering closed session for the purpose of a strategy
session regarding collective bargaining.

K. Adjournment
