Aubrey Trail Will Be Evaluated to Determine Competency to Stand Trial

LINCOLN — Aubrey Trail, accused in the slaying of Lincoln store clerk Sydney Loofe, will be evaluated to determine if he's mentally competent to stand trial. Saline County District Judge Vicky Johnson on Tuesday granted Trail's request for the competency evaluation. Trail, 52, will be examined by a psychiatrist, Dr. Klaus Hartmann of the Lincoln Regional Center, at a date to be determined. Trail and his 24-year-old girlfriend, Bailey Boswell, are charged with first-degree murder and illegal disposal of a body in the slaying and dismemberment of Loofe. She disappeared in November after arranging a date over the internet with Boswell. Her body was found in early December near Edgar, Nebraska. Trail is scheduled to stand trial in June 2019. No trial date has been set for Boswell. The state is seeking the death penalty for both. If Trail is found incompetent to stand trial, it could delay the trial or lead to a plea of not guilty by reason of insanity. But one of Trail's attorneys, Ben Murray of Hebron, said the goal was to determine, early on, if his competency would be an issue or not.
